Terms of sale

1. Scope
These terms of sale (the “Terms”) govern all sales of products made on hohojammies.com, hohopyjama.com and hohopyjama.fr (the “Website”) between:
- GEORGE22 LLC, company operating the “Ho Ho Jammies” / “Hoho Pyjama” brand, rue de Beaumont 9, 1206 Geneva, Switzerland, contact@hohopyjama.com (the “Seller”); and
- any individual acting for purposes outside their trade or profession who places an order on the Website (the “Customer”).
By placing an order, the Customer confirms that they have read and accepted these Terms. The Terms in force on the date of the order apply.
2. Products
Products are described and photographed with great care. Lifestyle photos are illustrations; the photo on a white background shows the product on its own. Slight differences in colour or appearance may occur.
Offers are valid while stocks last. If a product becomes unavailable after an order is placed, the Customer will be notified by email and refunded for that item as quickly as possible.
3. Prices
Prices are shown in US dollars (USD) on hohojammies.com and in euros (EUR) on hohopyjama.com and hohopyjama.fr. Larger orders may be shipped in several parcels. For deliveries to the United States, the Customer has nothing to pay on delivery.
Shipping is free, except to Switzerland: €5.90 ($6.90) per order. The price charged is the price displayed when the order is confirmed.
4. Orders
The Customer selects products, adds them to the cart and confirms the order by paying. The contract is formed when payment is confirmed. A confirmation email is sent to the address provided at checkout. The Seller may refuse an order in case of a previous dispute or suspected fraud.
5. Payment
Payment is made online at the time of ordering, by card or any other method offered on the secure checkout page of our payment provider Stripe. The Seller never has access to the Customer's full card details.
6. Delivery
Products are shipped with tracking by our logistics partner fron UE and USA . Estimated times:
- order processing: 1 to 3 business days;
- shipping to the United States: about 5 to 10 business days;
- shipping to UK and the European Union: about 5 to 10 business days;
- other destinations: available on request.
The tracking number is emailed as soon as the order ships. Delivery times are estimates; for consumers in the European Union, delivery takes place no later than 30 days after the order unless otherwise agreed. Otherwise, after asking the Seller to deliver within a reasonable additional period, the Customer may cancel the sale and receive a full refund.
The Customer is responsible for providing a correct delivery address. Risk of loss or damage passes to the Customer when they (or a third party they designate) take physical possession of the products.
7. Right of withdrawal and returns (14 days)
The Customer may cancel the purchase within 14 days of receiving the product (or the last parcel, for orders delivered in several parcels), without giving any reason and without penalty. This right is granted to all our customers, wherever they live.
To do so, the Customer sends us a clear statement (for example an email to contact@hohopyjama.com) or the model withdrawal form below, quoting the order number. We will then email the return address. The Customer must send the products back no later than 14 days after informing us of their decision.
Return shipping costs are paid by the Customer, unless the product is defective or not what was ordered. Products must be returned complete; the Customer may be liable for any loss in value caused by handling beyond what is needed to check their nature, characteristics and functioning (for example, normal trying on).
Items must be returned unworn, unwashed, in their original condition and with their labels attached. An item that has been worn, washed, stained, damaged or has had its labels removed loses value; this loss is deducted from the refund and may be up to the full price of the item.
We refund all amounts paid no later than 14 days after being informed of the withdrawal, using the same payment method as the original order. We may withhold the refund until we receive the products or until the Customer provides proof of shipment.

8. Warranties
Products are covered by the statutory warranties that apply in the Customer's country of residence. For consumers in France, this includes the legal guarantee of conformity (Articles L.217-3 et seq. of the French Consumer Code, two years from delivery) and the guarantee against hidden defects (Articles 1641 et seq. of the French Civil Code). For consumers in Switzerland, the warranty for defects under the Swiss Code of Obligations (Art. 197 et seq.) applies. If a product is defective or not as described, contact us with photos: we will offer a replacement or a refund, and return shipping is at our expense.
9. Liability
The Seller is not liable for failure to perform the contract due to force majeure or the act of a third party unrelated to the order. Nothing in these Terms limits or excludes liability where the law applicable to the consumer does not allow it.
10. Personal data
The data collected when ordering is needed to process and deliver the order. How it is handled is explained in our privacy policy.
11. Complaints and mediation
For any complaint, the Customer should first contact customer service at contact@hohopyjama.com. We are committed to finding an amicable solution.
12. Governing law and jurisdiction
These Terms are governed by Swiss law, excluding the United Nations Convention on Contracts for the International Sale of Goods (CISG). However, this choice does not deprive the consumer of the protection afforded by the mandatory provisions of the law of their country of habitual residence.
Subject to mandatory jurisdiction rules protecting consumers (in particular the Lugano Convention and Swiss law, which allow consumers to sue in the courts of their place of residence), the courts of Geneva (Switzerland) have jurisdiction.
13. Language
These Terms are available in English and French. In case of discrepancy, the English version prevails for orders placed on hohojammies.com and the French version for orders placed on hohopyjama.com and hohopyjama.fr.
